Even when you’re a celebrity…

When pop songstress Rihanna made her report of assault against R&B hit singer Chris Brown, it is very likely the police took quick measures to capture all the details of her complaint. In this case, Chris Brown was charged on February 8th, 2009 with two felonies of assault in connection to the altercation with Rihanna. The assault is being based on his “creating great bodily injury and criminal threats to her.” Most people are unaware that such threats as “I’m going to kill you,” even when they are not acted upon, are a serious crime. In this case, it appears that there were more than just words exchanged between the couple, but the words alone are enough to bring charges.

According to police search warrant information leaked to the media, the argument ensued between the dating couple after Rihanna read a text message from another woman on Chris’ cell phone. Brown allegedly attempted to push her out of a Lamborghini hitting her head against the passenger side window. Allegedly, Brown told Rihanna that he was going to beat her when they got home. Rihanna in turn left a message for her assistant saying, “I am on my way home. Make sure the cops are there when I get there.” Upon hearing her leave this message, Chris Brown reportedly replied, “You just did the stupidest thing ever. I’m going to kill you.” Apparently, the altercation escalated from there as has been widely reported in the press.

According to the LAPD police report, Brown was then booked on a felony criminal threat charge and released on a $50,000 bail bond. This is a typical bail amount in Los Angeles County. Upon Rihanna’s initial complaint, police would have had to prepare the report and act upon an official investigation immediately. She would have had to make an official statement regarding every detail of the assault. When it comes to the charge of assault, Police detectives need to know very specific details, like where the altercation took place, if there were any witnesses, why it started, etc. There are many different assault charges that range from aggravated assault, spousal abuse, felony criminal threats, assault with a deadly weapon, etc.

Upon the completion of their investigation, the police will make the determination of whether or not to officially charge the person being accused of assault. They also determine if there is enough information and evidence to stand up in a court of law. Regardless of if formal charges are made, once a bail bond has been posted, the bondsmen has earned his fee. Once the official statement is made and enough evidence is collected to verify the assault, the victim is not be able to “drop” the complaint. The police make the judgment of laying charges and proceeding with a prosecution.

Chris Brown’s arraignment is scheduled for March 6th, 2009. If he is convicted in court with this felony, he will be facing a prison term of approximately four years and eight months.
